The Board has received questions regarding businesses being operated out of the home that are
impacting the neighborhood. We have been waiting for the review of the 2015 Texas Legislature
activities to determine what authority the Association has over such activities. To put your mind at
ease, we have been informed by our attorneys that home offices, businesses simply based out of the
home and hobby activities have been protected by the Texas Legislature. However, we have also been
informed that the Association does have the authority to develop a policy to restrict certain business
activities by defining which activities we consider to be offensive and detrimental to the neighborhood.
Activities generating traffic congestion, the obvious presence of customers or employees and business
activities resulting in noise or odors would qualify. We consider developing this policy to be a high
priority and will begin working on this as soon as we have dealt with the 6 changes impacting HOA
elections, 4 changes impacting HOA meetings and 9 changes impacting HOA operations the Texas
Legislature has gifted us with that take effect September 1st

We recognize that there may be strong opinions on both sides of this issue as well as the possibility of
unintended consequences. For that reason we are attempting to develop a policy that is both fair and
enforceable.
